Data Privacy

We process relevant data, including but not limited to your name, contact details, education, professional experience, and salary information you provide. You are not legally or contractually obligated to disclose your personal data. However, without your personal data, we cannot accept your application and cannot inform you about suitable job opportunities if desired.

The legal basis for this processing is your active submission of your documents, including any cover letter. We interpret this as a clear indication of your interest in this position.

We retain your personal data for as long as necessary to fulfill the purpose for which we collected it, which may be an ongoing purpose. For example, if you are an applicant, we will retain your personal data for the duration of our business relationship with you and beyond, as we often support applicants for many years and potentially throughout their careers in finding employment opportunities.

In general, 12 months after you have actively applied, you will receive an email from us inviting you to continue storing your data with us by confirming through a link. If you do not confirm, your data will be deleted from our system.

If you agree to further storage, we will contact you at regular intervals via the email address you provided in your application to request your consent for extension or updates to your resume. If you do not actively agree to an extension, your documents will be automatically removed from our system. Updating your documents is considered active consent through a clear affirmative action.

We use your data solely to evaluate your qualifications for the position for which you have actively applied. We use your data for career counseling and job placement. As part of this application process, your data may be shared with our client through a secure communication platform. This platform is operated by our service provider (data processor Invenias by Bullhorn, based in Reading, United Kingdom, with a data center in the Netherlands). These service providers only access your data on a case-by-case basis or for support purposes. They are contractually bound by a data processing agreement in accordance with Article 28 of the GDPR to maintain confidentiality and implement data security measures. In this context, no personal data is processed in third countries.

If you have agreed to storage, we will also match your qualification profile with new vacancies and contact you if a new position seems interesting to you.

There are no automatic processes in our recruitment that result in applicants being automatically excluded from the application process or automatically suggested to any of our clients. The decision about which applicants are approached for which positions or forwarded to our clients is always made by the responsible consultant. Thus, there is no automated decision-making in accordance with Article 22 of the GDPR.

According to the GDPR and our principles, you have the following rights regarding your data:

  • Right of access: You may request information about the data we have stored and the duration of its storage at any time.
  • Right to rectification: If your data is incorrect or incomplete, you can request its correction or completion.
  • Right to restriction of processing and data portability: Under certain conditions, you can request that we restrict the processing of your data or provide it to you in a portable format, and you can object to the processing of your data.
  • Right to withdraw consent and right to erasure with future effect: You can withdraw your consent at any time and exercise your right to erasure. In such a case, we are obligated to delete your personal data unless we are entitled or required to retain it further. The withdrawal of consent does not affect the lawfulness of the processing based on the consent before its withdrawal.

Please contact us from the email address provided in your application at karriere@pendlpiswanger.at; this ensures we can verify your identity and the legitimacy of the deletion request.
